He’s not arguing that he needs to 50 year right in general. He’s already taken that as a given. He’s arguing that because the 50 year right is already a given for broadcast, it should be extended to the internet. In doing so he’s suggesting that the right already exists or is at least widely agreed upon, and neatly sidesteps the core argument.
